Welcome to SimpBunny (the “Platform”). These Terms of Service (the “Terms”) form a legally binding agreement between you (“you,” “User,” “Fan,” or “Creator”) and SimpBunny Media Inc. ("SimpBunny," “we,” “us,” or “our”) governing your access to and use of the Platform, our websites, apps, products, and services.
Adult content ahead. SimpBunny is for adults 18+ (or the age of majority in your jurisdiction, whichever is higher). No minors. If you are under the age of majority, do not use the Platform.
By accessing or using the Platform, you agree to these Terms and our Privacy Policy, Acceptable Use Policy, and Creator Payout Terms (collectively, the “Policies”). If you do not agree, do not use the Platform.

Age: You must be 18+ or the age of majority in your jurisdiction, whichever is greater. We may require age/ID verification ("KYC").
Creators: Additional KYC/AML and tax information may be required before enabling monetization.
Accuracy: Provide accurate information and keep it updated. One person = one account unless we approve otherwise.
Security: You are responsible for your login credentials and for all activity under your account.
Business use: If you use the Platform on behalf of a business, you represent you have authority to bind that entity.
SimpBunny hosts a social platform where adult Creators post content and Fans can follow, subscribe, tip, buy PPV posts, and message privately. Features may change at any time.
We provide hosting, discovery, payments facilitation (through third‑party processors), moderation tools, and support. We do not guarantee any level of income or audience.
Use the Platform lawfully and respectfully. Prohibited content and conduct include, without limitation:
Minors or young-looking persons (anyone under the age of majority), simulated minors, or any content that sexualizes minors.
Non-consensual content, exploitation, trafficking, doxxing, threats, harassment, hate, or discrimination.
Bestiality, incest, extreme violence, or content that violates law or our Policies.
Deepfakes/AI impersonation of real persons without explicit documented consent; misleading synthetic content.
Illicit services (solicitation/arranging prostitution where illegal), illegal drugs, weapons, fraud, money laundering.
Spam, scraping, reverse engineering, malware, or attempts to bypass security.

You retain ownership of the content you post ("User Content"). By posting, you grant SimpBunny a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, cache, reproduce, transcode, adapt, publicly perform, display, distribute, and otherwise use your User Content for operating, promoting, and improving the Platform. This license ends when you remove the content from the Platform, except where copies persist in backups, caches, or where others have already lawfully saved/paid for access.
You represent and warrant that you have all rights and consent needed to post the User Content, including model releases/consent records where applicable, and that posting does not infringe any third-party rights.
Monetization: Creators may offer subscriptions, PPV (pay-per-view) posts, bundles, tips, and other paid experiences.
Processor: Payments and payouts are handled by third-party providers. You must accept their terms and pass KYC/AML checks.
Fees: We may charge platform fees; we disclose fees in the Creator dashboard and/or payout terms.
Taxes: You are responsible for all taxes on your earnings. We may collect or remit taxes where required by law.
Chargebacks & fraud: We may reverse transactions, withhold amounts, or offset future payouts for refunds, chargebacks, or suspected fraud/violations.
Withholding: We may place holds on funds pending investigations or legal requests.

Auto-renewal: Subscriptions auto-renew until canceled. You can cancel anytime effective at the end of the current billing period.
Refunds: Except where required by law, all purchases are final and non-refundable once content is delivered/unlocked.
Access: Access to paid content is a license, not a sale. If a Creator or SimpBunny removes content or your account is terminated, you may lose access.
Pricing & taxes: Prices may include applicable taxes based on your location.
We collect and process personal data per our Privacy Policy. We use third‑party processors for payments, analytics, security, and compliance. By using the Platform, you consent to these practices.
Consent-first: All explicit content must be consensual and legal, with verifiable ages/identities of participants.
Records: We may require model releases and age/identity verification records (e.g., IDs and date-stamped consent forms). Keep records and provide them on request.
Reports: We investigate reports of illegal or non-consensual content and may suspend accounts or report to relevant authorities.
Child safety: Any suspected child sexual exploitation will be reported to appropriate organizations/law enforcement.
We reserve the right (but have no obligation) to review, remove, or restrict access to content or accounts at our discretion for violations, legal requests, or safety concerns. We may suspend or terminate accounts to enforce our repeat infringer policy and to protect the community.
Your IP: You own your trademarks and content, subject to the license granted in Section 5.
Our IP: The Platform, brand, software, and designs are owned by SimpBunny or its licensors. Do not copy, modify, or create derivative works without permission.
Trademarks: Do not use SimpBunny’s marks without our prior written consent.
The Platform may link to or integrate with third-party sites, apps, and services (e.g., payment processors). We are not responsible for their content, terms, or policies.
We may modify, suspend, or discontinue any feature or the entire Platform at any time, with or without notice. We do not guarantee uninterrupted service or permanent storage of content. Create your own backups.
The Platform is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.
If you believe content infringes your copyright, send a notice to dmca@simpbunny.com including:
Your contact information.
Identification of the copyrighted work claimed to be infringed.
Identification of the infringing material (URL) and enough information for us to locate it.
A statement that you have a good-faith belief the use is not authorized.
A statement under penalty of perjury that the information is accurate and that you are the owner or authorized to act.
Your physical or electronic signature.
We may notify the uploader and remove or disable access to the content. Repeat infringers may have accounts terminated.
Counter-notice: If your content was removed in error, you may send a counter-notice with sufficient detail and your consent to jurisdiction for resolution. We may restore content per applicable law.
In addition to Section 4, you agree not to:
Post, upload, or share any content involving: minors; non‑consensual acts; sexual violence; bestiality; incest; illegal acts; or content that violates local laws.
Post others’ personal data without consent; engage in stalking, harassment, hate, or threats.
Share dangerous content (malware, phishing, fraud) or instructions for illegal activities.
Impersonate others or misrepresent your identity.
Post deepfakes/AI content of real persons without explicit documented consent; undisclosed synthetic nudity.
Circumvent geo‑blocking, paywalls, or digital rights management.
Use bots, scrapers, or data mining without written permission.
Resell access, transfer accounts, or buy/sell stolen content.
Violations may result in content removal, suspension, termination, and referral to authorities.
You may close your account at any time. We may suspend or terminate your account for any violation of these Terms or our Policies, suspected fraud, risk, or as required by law. Upon termination, your license to use the Platform ends and we may delete or retain your content as permitted by law.
To the maximum extent permitted by law, SimpBunny and our affiliates, directors, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Platform, even if advised of the possibility of such damages. Our aggregate liability will not exceed the greater of (a) amounts paid by you to SimpBunny in the 12 months prior to the claim, or (b) USD $100.
Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the fullest extent permitted by law.
You agree to defend, indemnify, and hold harmless SimpBunny and our affiliates, directors, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Platform, or your breach of these Terms or the Policies.
Governing law: These Terms are governed by the laws of British Columbia, Canada, without regard to conflict-of-law rules.
Venue: You agree to the exclusive jurisdiction and venue of the courts located in Vancouver, British Columbia (or a small claims court of competent jurisdiction) for any dispute that is not subject to arbitration.
Arbitration (optional – update per counsel): At our election, disputes may be resolved by confidential, binding arbitration administered in English under the rules of a recognized arbitration body. You may opt out within 30 days of first agreeing to the Terms by emailing legal@simpbunny.com with subject “Arbitration Opt-Out.”
Mandatory consumer rights in your jurisdiction remain unaffected.
We may update these Terms from time to time. Material changes will be notified via the Platform or email. Changes apply prospectively from the “Last updated” date. If you continue using the Platform after changes take effect, you accept the new Terms.
If mandatory local laws grant you additional rights (e.g., cooling-off periods or withdrawal rights), those rights will apply. Where there is a conflict, the more protective rule for the consumer applies as required by law.
Entire agreement: These Terms and the Policies form the entire agreement between you and SimpBunny.
Severability: If any provision is invalid, the remainder remains in effect.
Assignment: You may not assign your rights; we may assign without restriction.
No waiver: Failure to enforce a provision is not a waiver.
Force majeure: We are not liable for delays/failures due to events beyond our reasonable control.
